These Terms of Service ("Terms") govern your access to and use of the Energy Labs North platform, including the website, data reports, and API (collectively, the "Service"). By accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Energy Labs North is a Canadian place intelligence platform. It provides neighbourhood data reports compiled from Canadian government open data sources. The Service is available in a free Standard tier and paid Professional, Business, and Enterprise tiers.

The Service is intended for use in Canada. We make no representation that the Service is appropriate or available outside Canada.

2. Accounts

To access full reports, you must register for an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate information when registering. You may not create accounts for others without their consent, create multiple accounts to circumvent usage limits, or share account credentials.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 24 months.

3. Acceptable Use

You may use the Service for personal research, internal business use, and professional purposes consistent with your subscription tier. You may not:

  • Scrape, crawl, or systematically extract data beyond what is expressly permitted by your tier's API access
  • Redistribute or resell data to third parties except as expressly permitted under a Business or Enterprise subscription
  • Use the Service to build a competing data product
  • Attempt to reverse-engineer, decompile, or extract the underlying datasets beyond what is provided through the API
  • Use the Service to discriminate against individuals in housing, employment, or credit decisions in violation of applicable Canadian human rights law
  • Misrepresent data from the Service as your own original data without attribution

4. Data and Accuracy

All data is sourced from Canadian government open data. We do not guarantee the accuracy, completeness, or fitness for any particular purpose of the data. Data may lag behind real-world conditions — see our methodology page for data vintage and known limitations.

Natural hazard and environmental data are for general informational purposes only. They are not a substitute for professional engineering assessment, a Phase I or Phase II Environmental Site Assessment, or insurance evaluation.

Crime data is not displayed at a geographic precision that could identify individuals. We follow Statistics Canada suppression rules.

5. Indigenous Lands Data

Where shown, "Federal Indian Reserve boundary" data reflects legislated boundaries from the Crown-Indigenous Relations Aboriginal Lands Legislative Boundaries dataset. This covers Indian Reserves and settlement lands under modern treaties only. It does not represent traditional territories, asserted title lands, or the full scope of Indigenous rights. This data is provided for informational context only and must not be used to make determinations about Indigenous land rights or title.

6. API Access

API access is governed by these Terms and the additional API Terms of Use. In the event of conflict, the API Terms of Use govern API usage.

7. Intellectual Property

The Service, including its design, software, and compiled data products, is owned by us or our licensors. The underlying government open data is licensed under the respective open government licences of each source — see our attribution page.

You retain ownership of any content you submit (such as contact form messages). By submitting content, you grant us a licence to use it to operate and improve the Service.

8. Fees and Payment

The Standard tier is free. Paid tiers are billed monthly or annually in Canadian dollars. All prices exclude applicable GST/HST. Payment terms are set out at the time of subscription. We reserve the right to change prices with 30 days' notice. If you cancel, access continues until the end of your paid period. No refunds are provided for partial periods.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD IF YOU ARE ON THE FREE TIER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service in violation of these Terms.

12. Termination

You may delete your account at any time by contacting us. We may terminate or suspend access to the Service at any time for breach of these Terms or for any other reason with reasonable notice, except in cases of serious breach where immediate termination may apply.

13. Governing Law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia, Canada.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
